Online Gambling – Is Online Gambling Legal?

While online gambling is a legal activity under federal law, each state also has the right to regulate and control it. This includes gambling on sporting events and on games of chance and skill. Twenty states, for example, permit residents to bet on sporting events online and to join poker sites. This list is by no means comprehensive.

There are a number of online casinos that offer various types of games. Some have download software to play their games, while others offer instant access to their games. Online casinos typically provide instructions on how to play their games. Some offer a variety of games, while others specialize in a particular type of gambling. However, most offer both options to their players.

Federal laws against online gambling have been challenged on several constitutional grounds. Several of these attacks, based on the Commerce Clause and the First Amendment’s guarantee of freedom of speech, have been unsuccessful. Commerce Clause doubts are satisfied by the commercial nature of the gambling business, while free speech objections are undermined by the limitations of First Amendment protection. The Due Process Clause and the First Amendment both suffer from questions of jurisdiction when financial transactions are involved.

Although legal online gambling is not permitted in every state, there is a growing presence in the market. In New Jersey, for instance, online casinos bring in over $80 million in tax revenue each month. Several other states have recently legalized online gambling.
